Michigan automatically expunges several types of convictions, but it is possible to clear more kinds of convictions through a court petition process. We work with partner organizations across the state to help people access free or low-cost help for a court petition expungement. Please note that individuals with more than 3 felony offenses will not be eligible for expungement through the petition process, unless they fall within the “One Bad Night” exception under the law. Additionally, the following offenses cannot be expunged:
-2nd or 3rd drunk driving offenses. If the individual has over 2 drunk driving cases, expungement can’t stop a license from being revoked by the State.
-Felony Domestic Violence if the individual has a prior misdemeanor domestic violence conviction
-Any offense punishable by a life sentence, like armed robbery.
-Any Traffic Offenses committed while operating a commercial vehicle
-Criminal Sexual Conduct (CSC) 1st, 2nd, and 3rd Degree
-CSC 4th Degree if committed on or after January 12, 2015
-Any Traffic Offenses causing injury or death
-Out-of-State and Federal Convictions
