Cada uno de nosotros pasamos gran parte de nuestro tiempo trabajando con personas que cumplen largas condenas de prisi\u00f3n, personas como Kennedy Matthews.<\/p>\n\n\n\n

Kennedy ha cumplido 55 a\u00f1os de prisi\u00f3n por un asesinato relacionado con la violencia callejera. Y morir\u00e1 en prisi\u00f3n, aunque est\u00e9 rehabilitado: es un pacificador, gu\u00eda y mentor para los hombres m\u00e1s j\u00f3venes en prisi\u00f3n. Ayuda a sus alumnos a trabajar en s\u00ed mismos y a evitar la violencia y otras malas conductas. Sentencia a Kenn<\/p>\n\n\n\n

Morir en prisi\u00f3n tampoco sirve al p\u00fablico. El dinero de los contribuyentes financia la costosa atenci\u00f3n m\u00e9dica de un anciano que ha vivido desde los 20 a\u00f1os en uno de los entornos m\u00e1s insalubres del pa\u00eds: una prisi\u00f3n estadounidense. Encarcelar a personas que causaron da\u00f1o hace 20, 30 o incluso 50 a\u00f1os es una venganza y un desperdicio.<\/p>\n\n\n\n

Michigan tiene algunas de las leyes de sentencias m\u00e1s estrictas del pa\u00eds. Casi la mitad de las personas en las prisiones de nuestro estado cumplen sentencias m\u00ednimas de 15 a\u00f1os o m\u00e1s, y 66% cumplen sentencias de al menos 10 a\u00f1os.<\/p>\n\n\n\n

cumpli\u00f3 d\u00e9cadas en prisi\u00f3n y utiliz\u00f3 ese tiempo para expiar sus acciones, mejorarse a s\u00ed mismos y ser mentores de otros. Al menos 17% de los encarcelados en Michigan tienen 55 a\u00f1os o m\u00e1s.<\/p>\n\n\n\n

Las investigaciones muestran que las personas envejecen para dejar de cometer delitos y que las personas encarceladas que cumplen sentencias m\u00e1s largas por da\u00f1os graves en el pasado son las que tienen menos probabilidades de volver a causar da\u00f1o en nuestras comunidades. De hecho, muchos ciudadanos que regresan dedican su tiempo a mejorar y hacer m\u00e1s seguras nuestras comunidades.<\/p>\n\n\n\n

Hay personas encarceladas en Michigan que est\u00e1n rehabilitadas y ya no representan una amenaza para el p\u00fablico. Pero actualmente no hay forma de que un juez modifique sus sentencias.<\/p>\n\n\n\n

Afortunadamente, no tiene por qu\u00e9 ser as\u00ed. Hay un mejor camino a seguir para Michigan.<\/p>\n\n\n\n

La soluci\u00f3n comienza con la aprobaci\u00f3n de la Ley de Sentencia de Segunda Vista. Esta legislaci\u00f3n permitir\u00eda a los jueces reconsiderar sentencias para personas que hayan cumplido al menos una d\u00e9cada de prisi\u00f3n y hayan demostrado su rehabilitaci\u00f3n.<\/p>\n\n\n\n

La palabra clave es "reconsiderar". Esta no es una tarjeta para salir libre de la c\u00e1rcel. El proceso implica una revisi\u00f3n por parte de un juez, quien considerar\u00eda cuidadosamente las aportaciones de la v\u00edctima, la gravedad del delito original, la historia y el comportamiento de la persona encarcelada y cualquier riesgo o beneficio para la sociedad.<\/p>\n\n\n\n

Si un juez decide volver a sentenciar a una persona bajo Second Look, esa persona a\u00fan pasar\u00e1 por el proceso regular de revisi\u00f3n de libertad condicional. La legislaci\u00f3n propuesta sobre Second Look incluye intencionalmente niveles de revisi\u00f3n antes de que una persona pueda ser liberada.<\/p>\n\n\n\n

La segunda mirada es especialmente importante dado el fracaso pasado de Michigan a la hora de brindar representaci\u00f3n legal adecuada a las personas indigentes. Hace s\u00f3lo nueve a\u00f1os que se cre\u00f3 la Comisi\u00f3n de Defensa de Indigentes de Michigan para garantizar que las personas que no pueden pagar un abogado reciban una representaci\u00f3n legal de calidad.<\/p>\n\n\n\n

Antes de 2014, el sistema de defensa para indigentes de Michigan era totalmente inadecuado. La Asociaci\u00f3n de Abogados de Estados Unidos expres\u00f3 su apoyo a la legislaci\u00f3n Second Look en una resoluci\u00f3n de 2022.
