{"id":267894,"date":"2026-09-03T22:57:22","date_gmt":"2026-09-04T02:57:22","guid":{"rendered":"https:\/\/votingaccessforall.org\/?p=267894"},"modified":"2026-09-03T22:57:25","modified_gmt":"2026-09-04T02:57:25","slug":"breaking-news-acvm-proposal-will-not-appear-on-michigans-november-ballot","status":"publish","type":"post","link":"https:\/\/votingaccessforall.org\/es\/2026\/09\/breaking-news-acvm-proposal-will-not-appear-on-michigans-november-ballot\/","title":{"rendered":"BREAKING NEWS: ACVM Proposal Will Not Appear on Michigan\u2019s November Ballot"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>The question is now settled for Michigan voters: the Americans for Citizen Voting-Michigan constitutional amendment will not appear on the November 3 ballot.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.courts.michigan.gov\/c\/courts\/msc\/case\/170595\" target=\"_blank\" rel=\"noreferrer noopener\">On September 3, the Michigan Supreme Court denied ACVM\u2019s request to overturn the Board of State Canvassers\u2019 decision and order the proposal onto the ballot.<\/a> <strong>This resolves the remaining state court challenge over whether the proposal would appear on the 2026 ballot.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier, ACVM had also asked the U.S. Supreme Court to intervene. That request was denied. With the state court challenge now decided as well, the question of whether the proposal will appear on the November ballot is settled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For Michigan voters, the result is final for this election: the ACVM proposal will not be on the November ballot.<\/strong><\/p>\n\n\n\n<h3 id=\"what-the-michigan-supreme-court-decided\" class=\"wp-block-heading\"><strong>What the Michigan Supreme Court decided<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">After the Board of State Canvassers did not certify the proposal, Americans for Citizen Voting-Michigan, or ACVM, asked the Michigan Supreme Court to step in.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ACVM argued that some petition signatures rejected during the state review should have been counted and that the campaign did not have enough time to challenge the Bureau of Elections\u2019 findings before the ballot deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Michigan Supreme Court denied the campaign\u2019s request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/bridgemi.com\/michigan-government\/citizenship-voting-proposal-denied-ballot-access-by-us-michigan-supreme-courts\/\" target=\"_blank\" rel=\"noreferrer noopener\">The court concluded that ACVM was not entitled to an order requiring the Board to certify the proposal.<\/a> The court said the Board acted within the authority it has under Michigan law when reviewing the petition and deciding whether enough valid signatures had been submitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court also addressed ACVM\u2019s concerns about the timing of the review and the use of affidavits from voters whose petition signatures had been rejected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under current Michigan law, there is no specific deadline requiring the Bureau of Elections to complete this type of petition review within a certain number of days after signatures are submitted. <a href=\"https:\/\/bridgemi.com\/michigan-government\/citizenship-voting-proposal-denied-ballot-access-by-us-michigan-supreme-courts\/\" target=\"_blank\" rel=\"noreferrer noopener\">The court said the Michigan Legislature could change the law to create clearer timelines and rules for when affidavits can be used to support rejected petition signatures.<\/a><\/p>\n\n\n\n<h3 id=\"how-we-got-here\" class=\"wp-block-heading\"><strong>How we got here<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">At its August 24 meeting, Michigan\u2019s bipartisan Board of State Canvassers spent nearly seven hours reviewing disputed petition signatures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By the end of that review, <a href=\"https:\/\/www.votebeat.org\/michigan\/2026\/08\/25\/proof-of-citizenship-americans-for-citizen-voting-amendment-deadlock\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>626 of the 1,000 sampled signatures had been accepted as valid<\/strong>, three short of the 629 needed for certification<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The four-member Board then deadlocked 2-2 on whether to certify the proposal.
